Service Agreement, Liability Waiver & Device Intake Form
This Service Agreement and Liability Waiver (“Agreement”) is entered into between HackIt Tech, operated by Aiden Hackett (“HackIt Tech,” “we,” “us”), and the undersigned customer (“Customer,” “you”), in connection with technology repair, maintenance, consultation, or related services (the “Services”) provided by HackIt Tech. By signing below (or checking the acknowledgment box in the HackIt Tech ticketing system), you agree to the terms of this Agreement.

01Device ownership & authorization
You confirm that you are the legal owner of the device submitted for service, or that you have the owner’s express authorization to have it serviced, and that you have the authority to enter into this Agreement on the device owner’s behalf. HackIt Tech is not responsible for verifying ownership beyond your representation here, and you agree to indemnify HackIt Tech against any third-party claim arising from a misrepresentation of ownership or authorization.
02Device passwords, encryption & account access
Customer understands that certain services may require device passwords, encryption keys (e.g., BitLocker recovery keys), recovery keys, administrator credentials, or account access. If required access is not provided, HackIt Tech may be unable to complete or verify the requested service. HackIt Tech is not responsible for incomplete repairs or unrecoverable data resulting from unavailable credentials.
03Data backup & data loss
You acknowledge and agree that:
- Backing up your data before service is your responsibility. HackIt Tech strongly recommends a full backup prior to any repair, and will ask whether a backup exists, but is not responsible for confirming or performing one unless a backup or data-transfer service is separately requested and paid for.
- Data loss is a possible outcome of any repair, especially work involving storage devices, operating systems, or physically damaged hardware, and can occur even with reasonable care.
- HackIt Tech is not liable for loss of data, files, software licenses, or account access resulting from service, except where loss is directly caused by HackIt Tech’s gross negligence or intentional misconduct.
- Data recovery services (where offered) are limited to software failures or drives that are degrading but still readable. Devices with physical/hardware-level drive failure are not serviced in-house; HackIt Tech will refer you to a specialized data recovery provider if you wish to pursue further recovery, and is not responsible for the cost or outcome of that third-party service. Data recovery is inherently probabilistic — no specific outcome or percentage of recoverable data is guaranteed.
04Pre-existing condition & device intake
At intake, HackIt Tech will note the device’s visible condition (including any existing damage, missing components, or cosmetic issues) to the extent reasonably observable. You agree that this intake record, along with any photos taken, represents the device’s condition at the start of service, and that HackIt Tech is not responsible for pre-existing damage not caused during the course of service. Existing cosmetic wear may become more apparent after cleaning or disassembly, and does not constitute damage caused by HackIt Tech.
05Consumer plastic components
Many consumer-grade laptops and electronic devices use plastic clips, screw mounts, and other structural components that may become brittle or weakened over time due to normal age, heat, previous repairs, or prior physical stress. Despite the exercise of reasonable care, these components may crack, break, or separate during necessary disassembly or reassembly.
If such damage occurs as a result of the normal repair process and not from unreasonable care or reckless handling, HackIt Tech may, at its discretion, reinforce or repair affected plastic components using appropriate repair methods or adhesives where doing so is safe and practical. Cosmetic imperfections resulting from these repairs may occur. Customer acknowledges that such repairs are sometimes preferable to full replacement of the affected housing and do not constitute negligent workmanship.
06Liquid damage & severe physical damage
Devices with liquid damage, corrosion, or severe physical damage may experience additional failures during or after service despite reasonable care. Customer acknowledges that such devices inherently carry elevated repair risk, and that a device appearing functional after initial service may still develop further issues related to the original damage.
07Firmware & BIOS updates
Firmware and BIOS updates carry an inherent, if uncommon, risk of rendering a device inoperable due to factors including but not limited to power interruption, pre-existing hardware faults, or manufacturer defects in the firmware itself. HackIt Tech will take reasonable precautions, but is not liable for such failures except where caused by HackIt Tech’s gross negligence or intentional misconduct.
08Manufacturer warranty
Customer acknowledges that certain repairs, upgrades, or the act of opening the device may affect or void the manufacturer’s warranty. Customer is responsible for understanding their own device’s warranty terms before requesting service.
09No guarantee of repair
Some issues cannot be fully diagnosed or resolved, including but not limited to issues caused by manufacturer defects, prior repair attempts by others, physical damage, or component failure discovered mid-repair. HackIt Tech will communicate realistic expectations once the scope of an issue is known, but does not guarantee that every device can be repaired.
10Diagnostic & service fees
A diagnostic fee applies regardless of whether a repair is ultimately performed, except where HackIt Tech is unable to reach a diagnosis due to its own reasonable fault. Current diagnostic and service pricing is available at hackittech.com and is incorporated into this Agreement by reference; all listed prices are starting prices and may increase for unexpected complexity, irregular hardware (including Apple devices), or other atypical circumstances, which will be communicated to you before additional charges are applied where practical. Estimated completion dates are subject to supplier and shipping delays outside HackIt Tech’s control.
11Parts, payment & sourcing
- Where a part must be ordered, Customer agrees to pay for the part (including HackIt Tech’s sourcing markup) before the part is purchased. This payment is separate from and in addition to final payment for labor, which is due upon completion/return of the device.
- If a sourced part fails and the failure is not due to HackIt Tech’s installation or workmanship, HackIt Tech will assist in facilitating a warranty claim through the original supplier where the part remains within its warranty period. This is best-effort facilitation, not a guarantee of replacement or refund, which remains subject to the supplier’s own warranty terms.
- Accepted payment methods are Square (in person), Zelle, and Apple Cash. Standard repair payment is due upon return of the device.
12Customer-supplied parts
HackIt Tech cannot guarantee the compatibility, quality, or reliability of parts supplied by the Customer rather than sourced by HackIt Tech. Labor charges remain applicable even if customer-supplied parts are defective, incompatible, or fail during or after installation, provided reasonable care was exercised during installation.
13Workmanship warranty
HackIt Tech warrants its own workmanship for 30 days from the date of completion. If the same issue, or an issue substantially related to the original repair, recurs within that period, HackIt Tech will perform the re-repair at no additional charge. This warranty covers workmanship only and does not cover failure of the physical part itself where that failure is not caused by HackIt Tech’s installation (see Section 11 for the part-failure process), nor does it cover new or unrelated issues arising after service.
14Device pickup & abandonment
Once notified that a device is ready, Customer has 30 days to arrange pickup. HackIt Tech will make reasonable attempts to contact Customer during this period. If Customer responds but is genuinely unable to retrieve the device, storage arrangements may be discussed at HackIt Tech’s discretion. If Customer does not respond after multiple reasonable contact attempts and the 30-day window has passed, HackIt Tech reserves the right to dispose of, recycle, liquidate, or otherwise handle the device as it deems appropriate, consistent with applicable Arizona unclaimed property practice.
15Home visit terms
The following applies specifically when Services are performed at Customer’s residence or other location chosen by Customer:
- Customer agrees to provide a reasonably safe, accessible working environment, including securing any pets and clearing a reasonable workspace for HackIt Tech to perform the Services.
- A travel fee applies based on distance, per current published rates. Cancellations made less than one hour before a scheduled visit may be charged the applicable travel/base fee, though this may be waived at HackIt Tech’s discretion where the cancellation has no realistic scheduling impact.
- HackIt Tech is not responsible for pre-existing conditions of the home or property, and Customer is responsible for any hazards not disclosed in advance (e.g., unsafe electrical conditions, structural issues, aggressive animals not secured).
16Remote support terms
Remote support is limited to software troubleshooting that does not require physical hardware access, such as login/account issues, driver installation, and general guidance. Remote sessions do not include full operating system reinstallation or any action carrying material risk of the device losing network connectivity or becoming unable to boot, as this could strand the session without a path to resolution. Issues requiring hardware access or full OS reinstallation require an in-person visit.
17Data privacy during service
Customer understands that technicians may necessarily encounter personal files or information while performing requested services. HackIt Tech will make reasonable efforts to avoid accessing personal data beyond what is necessary to complete the requested work, and will treat customer information as confidential, consistent with HackIt Tech’s Privacy Policy.
18Photographs & documentation
Photographs may be taken before, during, or after service for documentation, quality assurance, warranty records, or dispute resolution. These documentation photos will not be used publicly without Customer’s separate permission. HackIt Tech may separately request Customer’s permission to use certain photos (e.g., before/after repair work) for portfolio or promotional purposes; Customer is free to decline any such request without affecting the Services provided.
19Customer responsibilities
Customer agrees to:
- Provide accurate contact information.
- Promptly respond to requests for approval or additional information.
- Retrieve completed devices within the stated pickup period.
- Maintain backups of their data where appropriate.
- Disclose known issues, prior repair attempts, liquid damage, or modifications that may affect service.
20Limitation of liability
To the fullest extent permitted by law, HackIt Tech’s total liability arising from any claim related to the Services shall not exceed the amount actually paid by Customer for the specific service giving rise to the claim. This limitation applies to claims for data loss, device damage, or any other loss arising from the Services, except to the extent caused by HackIt Tech’s gross negligence, recklessness, or intentional misconduct, for which this limitation does not apply, consistent with Arizona law.
21Force majeure
HackIt Tech is not liable for delays or failure to perform Services caused by circumstances beyond its reasonable control, including but not limited to fire, flood, power outage, shipping or supplier delays, or other events of force majeure.
22Informal resolution
If a dispute arises under this Agreement, both parties agree to make a good-faith effort to resolve it directly before pursuing any formal legal action.
23Governing law
This Agreement is governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
24Acknowledgment
By signing below (or checking the corresponding acknowledgment box at ticket creation), Customer confirms they have read, understood, and agree to the terms of this Agreement, including the sections on data loss, pre-existing condition, limitation of liability, and — where applicable — home visit or remote support terms.
25Device intake details
